Terms and conditions

1. Contractual Scope

This document defines the General Terms and Conditions of Stay (hereinafter “TOS”), which govern the offer and provision of hospitality services by:
• Turist s.r.l. (hereinafter “Mamaco” or the “Provider”), VAT/Tax ID: 04161600723, with registered office at Via Francesco Crispi 65, Foggia (FG).

These conditions apply to all reservations made through the website mamacostays.com, connected booking platforms, and/or directly with the Provider, and are deemed accepted by the Guest upon confirmation of the reservation.

2. Booking and Payment

Formation of the Contract
The accommodation contract is considered finalized when Mamaco receives payment (either full or as a deposit, depending on the selected rate) and sends the Guest the booking confirmation.

Prices and Taxes
The accommodation prices are those indicated in the booking confirmation and include VAT.

Payment Methods
Payment must be made using the methods accepted on the website. The Guest guarantees that they are the holder of or have full authorization to use the payment method provided.

3. Check-in and Access Policies (Self Check-in)

Mandatory Online Check-in Procedure
The Guest is required to complete the online check-in process and provide all requested documents and data, including those necessary for communication to Public Security, before the established arrival time.

Responsibility for Data Accuracy
The Guest declares to be directly responsible for the accuracy and completeness of the data provided during the online check-in procedure. Failure to provide, incomplete, or false communication of mandatory data required for Public Security constitutes a serious contractual breach and may result in immediate cancellation of the booking without refund.

Access
Once the online check-in procedure is completed, Mamaco will send the Guest credentials and/or virtual keys to access the property and the booked accommodation independently. Check-in time begins at 3:00 PM.

Check-out
The accommodation must be vacated by 10:30 AM on the day of departure. Unauthorized late check-out will incur a penalty equal to the cost of an additional night.

4. Cancellation and Modification Policies

Cancellation and modification terms vary depending on the rate selected at the time of booking. The Guest is required to review the specific applicable policy.
• In case of no-show without prior notice, the total amount of the stay will be charged and is non-refundable.
• Force Majeure by the Guest and Non-Refundable Rates: The Guest’s inability to reach the property due to events not attributable to Mamaco (e.g., transport strikes, flight delays, adverse weather, personal or health emergencies, etc.) does not constitute grounds for cancellation with refund rights if a non-refundable rate was selected. The travel risk remains entirely with the Guest.

5. Guest Obligations, Rules, and Penalties

House Rules and Penalties
The Guest agrees to strictly comply with the following internal rules:
• No Smoking: Smoking is strictly prohibited inside the accommodations and all indoor common areas. Violation will result in an automatic penalty of €200.00 for extraordinary sanitation and may lead to immediate termination of the stay without refund.
• Undeclared Guests (Maximum Occupancy): Hosting individuals not declared at the time of booking and online check-in is strictly forbidden. The presence of unregistered guests will incur a penalty of €50.00 per person per day and may lead to immediate cancellation of the booking and removal from the property without refund.
• Quiet Hours: Respect rest hours, particularly between 10:00 PM and 8:00 AM.
• Damages: The Guest is responsible for any damage caused to the accommodation, furnishings, or contents during the stay and accepts the charge for repair or replacement costs.
• Fairness in Complaints and Reviews: Before posting negative or defamatory reviews regarding the stay on public platforms, the Guest agrees to contact Mamaco (Turist s.r.l.) in writing within 48 hours after check-out, allowing a 7-day period to amicably resolve any issues or complaints.

Video Surveillance for Property Protection
The property is equipped with video surveillance cameras in external common areas and/or access points solely to protect company assets and ensure safety (as detailed in the Privacy Policy). These cameras are not installed inside private accommodations.

Virtual Keys
Virtual keys are strictly personal. The Guest is responsible for the security of the device used for access and for safeguarding the login credentials.

6. Limitation of Liability of the Provider

Mamaco (Turist s.r.l.) is not liable for:

Valuables and Health: Damage, loss, or theft of personal belongings left in the accommodation or common areas. Guests are strongly advised not to leave cash, jewelry, or other valuables in the room. Mamaco is also not responsible for injuries, illnesses, or health issues suffered by Guests during their stay, except in cases of willful misconduct or gross negligence by the Provider.

External Information and Accuracy: Mamaco is not responsible for inaccurate, miscommunicated, or incomplete information, prices, or availability from third-party booking platforms (OTAs). The only binding information and contractual terms are those published on mamacostays.com and included in the official booking confirmation sent directly by the Provider.

Access Failure Due to Technical Malfunction: Interruptions or malfunctions of internet service (Wi-Fi), virtual keys, or access systems caused by force majeure or external faults. If the malfunction is directly attributable to the Provider, Mamaco commits to providing an alternative access method (e.g., manual code or on-site assistance) as soon as possible, but is not responsible for any temporary inconvenience or delay caused.

Interruptions or Failures of Essential Services: Interruptions of electricity, gas, or water caused by force majeure or third-party providers (e.g., utility operators).

Reliability of Automated Assistance Systems (AI/Chatbots): Mamaco does not guarantee the accuracy or reliability of information provided by automated assistance systems. For contractual or legal matters, the Guest must refer to the human support team.

7. Governing Law and Jurisdiction

This contract and the provision of services are governed by Italian law.

Prevalence of the Italian Language
This document is written in Italian. If translated into other languages for convenience or clarity, the Italian version shall prevail in the event of any conflict, discrepancy, or interpretative ambiguity. Any translation cannot be considered legally or contractually binding. Turist s.r.l. is not responsible for any errors, inaccuracies, or misunderstandings arising from translations of this document or any other website content.

For any dispute arising from the interpretation or execution of this contract, the exclusive jurisdiction shall be the Court of Foggia.
